These Terms govern access to the RM//VorteX website, customer accounts, digital products, software licences, downloads, updates and support services.

By creating an account, placing an order or using an RM//VorteX product, you agree to the terms that apply to the relevant service, licence or purchase.

Digital Purchases

Orders cover downloadable software, licences, themes, extensions and related digital services.

Licensed Use

Software is licensed under the conditions displayed for the relevant product and is not sold without restriction.

Digital Delivery

Approved purchases may be delivered through customer downloads, account access or licence activation.

Support & Updates

Support and update entitlements depend on the selected product, licence and service period.

When do these Terms apply?

These Terms apply to visitors, registered customers and purchasers using the RM//VorteX website, customer accounts, downloads, software, extensions, themes, licences, updates and support services.

Additional product-specific terms, licence conditions or service descriptions may apply. Where specific terms conflict with these general Terms, the specific terms applicable to the purchased product or service take priority.

Account registration and security

Certain products and services require a customer account. Information supplied during registration must be accurate, current and complete.

  • You are responsible for protecting your login credentials.
  • You must not share account access with unauthorized persons.
  • You must notify us if you suspect unauthorized access.
  • One person or business must not create accounts for abusive purposes.
  • Account information must not impersonate another person or entity.

RM//VorteX may request verification where reasonably required for security, fraud prevention, licensing or account recovery.

How is a purchase concluded?

Product pages describe the main characteristics of the relevant software, extension, theme, licence or service. Before placing an order, customers can review the selected products, price, currency, billing information and applicable conditions.

An order submitted through the checkout constitutes a request to purchase. The contract is concluded when RM//VorteX accepts the order, confirms payment where required and makes the purchased product or service available.

RM//VorteX may refuse or cancel an order where there is evidence of fraud, pricing error, unauthorized payment, sanctions restrictions, technical failure or violation of these Terms.

Pricing, currencies and tax

Prices are displayed in the selected storefront currency. The primary accounting currency may differ from the currency selected by the customer.

Applicable taxes, VAT, duties or charges may depend on the customer's location, customer type, billing details and legal status. The final amount due is displayed during checkout before the order is submitted.

Customers are responsible for supplying accurate billing and tax information. Business customers may be asked to provide a valid tax or VAT identification number.

Payment processing

Available payment methods are shown during checkout. Payments may be processed by independent payment providers under their own contractual and privacy terms.

Products, licences and downloads may remain unavailable until payment is successfully authorized and the order reaches an approved status.

In the event of a chargeback, reversed payment, fraudulent transaction or unpaid amount, RM//VorteX may suspend the associated account, downloads, licences, updates and support access.

How are products delivered?

RM//VorteX products are generally supplied digitally. Delivery may occur through:

  • Download links in the customer account
  • Licence keys or licence activation
  • Access to an update or marketplace service
  • Email containing order or access information
  • Manual delivery where installation or customization is included

The customer is responsible for ensuring that the provided email address, account details, server environment and technical requirements are correct and compatible with the purchased product.

Permitted use of RM//VorteX products

Unless expressly stated otherwise, RM//VorteX software is provided under a limited, non-exclusive, non-transferable licence for the number of stores, domains, installations or users specified at purchase.

You may

  • Install and use the product within the purchased licence scope
  • Make reasonable backup copies for your own licensed installation
  • Modify files for your own lawful use where the licence permits it
  • Use documentation supplied with the purchased product

You may not

  • Redistribute, resell or share licensed files without permission
  • Publish licence keys, downloads or protected source code
  • Use one licence across more installations than permitted
  • Remove copyright, attribution or licence notices unlawfully
  • Use the product to distribute malware or conduct unlawful activity
  • Circumvent licence, authentication or update mechanisms

Open-source components included within a product remain subject to their respective licences. Product-specific licence notices identify any separate conditions that apply.

Product maintenance and assistance

Update and support entitlements depend on the relevant product, licence and service description. Purchase of a product does not automatically guarantee perpetual updates or unlimited support unless this is expressly stated.

Support may include assistance with installation, configuration, confirmed product defects and documented compatibility. It may exclude:

  • Custom development not included with the purchase
  • Third-party extension or theme conflicts
  • Server administration outside the agreed service scope
  • Problems caused by unauthorized modifications
  • Unsupported software, PHP or OpenCart versions
  • Damage caused by user error or compromised infrastructure

Updates may introduce security fixes, compatibility changes, new features or deprecations. Customers should maintain backups and test updates appropriately before applying them to production stores.

External software and services

RM//VorteX products may integrate with third-party software, services, APIs, payment providers, themes or extensions. Those products remain subject to their own terms, licences, availability and technical requirements.

Unless expressly agreed otherwise, RM//VorteX is not responsible for changes, outages, defects or licensing decisions made by independent third-party providers.

Digital products and withdrawal rights

Refund eligibility depends on the applicable law, the customer's location, the nature of the product and whether digital delivery, download, licence activation or service performance has already begun.

Where a customer expressly requests immediate access to digital content and acknowledges the consequences for any applicable withdrawal right, delivery may begin before the standard withdrawal period has expired.

A refund will not normally be granted merely because:

  • The customer changed their mind after digital access began
  • The customer failed to check published technical requirements
  • The product conflicts with an undisclosed third-party modification
  • The customer no longer needs the product
  • The licence or files have been shared, copied or misused

Nothing in these Terms removes mandatory consumer rights that cannot lawfully be excluded. Requests should be submitted to RM//VorteX Support with the order number and a clear description of the issue.

Your responsibilities

The customer is responsible for:

  • Checking product requirements before purchase
  • Maintaining reliable backups
  • Protecting accounts, licences and downloaded files
  • Testing updates before production deployment
  • Maintaining server, PHP, database and platform compatibility
  • Using the product lawfully and within the licence scope
  • Providing sufficient information when requesting support

Ownership and attribution

RM//VorteX names, branding, documentation, original designs, original code and other protected materials remain the property of their respective rights holders.

OpenCart and third-party components remain owned and licensed by their respective authors. Nothing in these Terms transfers ownership beyond the rights expressly granted under the applicable licence.

Service limitations

RM//VorteX aims to provide reliable and properly maintained products, but software may contain defects, depend on external components or be affected by server configuration, third-party modifications and future platform changes.

To the maximum extent permitted by applicable law, RM//VorteX is not liable for indirect, incidental or consequential loss, loss of profit, loss of data, interrupted business, reputational damage or damage caused by unauthorized modifications, third-party software or failure to maintain backups.

Any limitation of liability applies only to the extent permitted by mandatory law and does not exclude liability that cannot lawfully be excluded.

Restriction of access

RM//VorteX may suspend or terminate access to accounts, licences, downloads, updates or support where reasonably necessary because of:

  • Fraudulent or unauthorized payment activity
  • Licence sharing or unlawful redistribution
  • Security threats or attempted system abuse
  • Violation of these Terms
  • Legal or regulatory obligations
  • Repeated abusive behaviour toward support personnel

Where appropriate, reasonable notice or an opportunity to correct the issue may be provided.

Personal information

Personal information is processed in accordance with the RM//VorteX Privacy Policy, which explains the categories of data collected, purposes of processing, service providers, retention and applicable rights.

Updates to contractual conditions

These Terms may be updated when products, services, legal requirements or platform operations change. The current version will be published on this page with its revision date.

Terms applying to a completed purchase are generally those accepted at the time of that purchase, except where a later change is required by law or expressly agreed.

Governing law and jurisdiction

These Terms are governed by Swiss law, subject to any mandatory consumer protection provisions that apply in the customer's country and cannot lawfully be excluded.

The competent courts are determined under applicable law. Nothing in this clause removes a consumer's mandatory right to bring proceedings before another competent court where such a right applies.
